The decision of the Supreme Court in R (Worcestershire County Council) v Secretary of State for Health and Social Care [2023] UKSC 31 has shone a spotlight on the complexities to which s.117 MHA 1983 can give rise. Further, whilst it has given much-needed clarity in relation to some areas, there remain practical and principled questions that public authorities have to grapple with when navigating the legislation. In this seminar, chaired by Alex Ruck Keene KC (Hon), expert speakers from the 39 Essex Chambers Public Law and Court of Protection teams will both set out road-maps for public authorities through s.117 and answer questions about the legislation and its interpretation by the courts.
