How Much Are Herniated Disc Injury Cases Worth? Understanding the Settlement Value of Your Claim.

If you have a herniated disc injury, you want to know what the settlement amount of your claim might be. The problem you are probably having if you look at sample verdicts and settlements in herniated disc injury cases, you find they are all over the map. There are $5,000 verdicts and multi-million dollar verdicts. How do you make sense of that? There is a path to help you better understand the settlement value of your case. Six factors really matter in helping you figure out whether you are closer to the $5,000 settlement or the $1 million settlement. This video explains those factors. When you finish watching it, will you know your case's exact settlement value? Of course not. But you will have a better sense of the settlement range and the strengths and weaknesses of your case. How Time and Lawyering Make a Difference The one thing I talk a little about in the video is the timing of a settlement in a herniated disc injury case. When the value of a case has a wide range as herniated disc injury cases have, each side naturally takes the most favorable position to the outcome they want. Plaintiffs' lawyers, like me, shoot for the moon in a way that is not always realistic. I'll be the first to admit. But insurance companies are far more guilty of shooting for their version of the moon than I am. What results from all of this? Both sides are way too far apart for settlement. In most herniated disc injury cases, the only path to maximize the claim's value is to sue. If you are looking for money quickly, this is not what you want to hear, right? But it is not uncommon for the settlement value of a case to increase tenfold over the course of the litigation process. Some of my clients understand that the value of these cases increases over time and still want to settle their cases. Why? Because they need money now. While I advise against leaving a lot of money on the table, I understand that for some people, their economics or lack of desire to be involved in litigation trumps my desire to get every last penny I can. For those clients, I'm still battling to get every last penny when I settle their cases. I just don't have the leverage that comes with filing a lawsuit. This does not mean every herniated disc injury claim should be put into suit. Our lawyers see herniated disc injury cases where the medical records the insurance company is seeing inflate the real value of the case. A good lawyer will fight like crazy to get the best settlement for you in this case. But these are the cases you want to settle before or just after filing a lawsuit. How Settlement Amounts are Determined The settlement value of herniated disc injury claims can vary widely depending on the injury's severity and the claim's specific circumstances. It is trite to say every case is different. But every case is very different. But you can generally say that the settlement payouts for herniated disc injury claim will depend on a few key factors: the jurisdiction, the extent of the injury, the impact on the injured person's daily life and ability to work, the age of the plaintiff, whether there were prior injuries, and the level of medical treatment required. All things being equal, as you might expect, more severe herniated disc injuries that require surgery or other significant medical treatment may result in higher settlement values. There is a big gap between getting surgery and saying you will get surgery in terms of settlement compensation.
