My son died in an accident and is survived by his wife and daughter. I plan to sell the house. Can my daughter-in-law claim her share in the sale amount? Answer: Yes. It would be proper if you obtain release deed from your daughter in law surrendering her share in the flat in your favour. The release deed should be registered by the authorities and informed to the society. In case , you are not taking any consent from daughter-in-law , you can proceed with the sale of the flat and sell the flat without obtaining the consent of your daughter-in-law, however, if she later on claims any amount , then you will have to give 50 % share out of the sale proceed to her.
