Subscribe to my personal channel for videos on how to study law effectively & efficiently:    / @heygarethevans   Schedule 3 lists nine rights in rem which take priority over a newly granted/transferred right in rem. It says in relation to these rights in rem, these rights in rem can take priority under s29 over the newly granted/transferred right in rem in question. So we saw that one way in which a pre-existing right in rem can take priority is if it is registered (the first route), but the second route is here under schedule 3. So if your right falls under schedule 3 then that is great – you satisfy s29 and your right will take priority over the new interest (whether that be a freehold, mortgage or a lease etc.), the pre-existing interest will take priority over it (so bind it) if it falls under schedule 3. Priority is achieved by the rights listed in Schedule 3 despite the fact that they are unregistered (i.e. they are not noted on the Charges Register of the estate in land which they burden). Our focus, out of the 9 rights, is the rights under paragraph 1, 2 and 3 – so the beginning of the schedule is what we need to focus on.
