Public Law - Chapter 8: Judicial Review (Degree - Year 1) Judicial review is a mechanism that courts use to scrutinise and control executive power, ensuring that public bodies act within powers conferred by case law and statute. This provides for a system of check and balance, which is quintessence to the rule of law because executive arbitrariness is prevented and individual rights are upheld. Lord Diplock in the landmark case of Council for Civil Service Unions v Minister of State for Civil Service (better known as the GCHQ case) had established the grounds for judicial review, i.e. illegality, irrationality and procedural impropriety. Furthermore, he foresaw the possibility of “proportionality” being used as a separate ground. Indeed, this has become the fourth ground in light of the passing of the Human Rights Act 1998.
