The basic premise of a settlement agreement: any discussion designed to lead to the termination of employment (with a compensatory package) - usually an accompanying settlement agreement will be protected from disclosure in front of any subsequent employment tribunal. These new initiatives in employment law were generally well accepted in the HR community however there are fundamental issues that need to be overcome. The protection from immunity within the employment tribunal is lost if the employee alleges discrimination or the employer acts improperly.
