If there were a Mount Rushmore for lawyers, former federal appeals court Judge Michael Luttig would be its centerpiece. His towering credentials and unspotted character have made the judge a legend among constitutional mavens. Judge Luttig uniquely has resisted Faustian bargains to trade away his intellectual integrity for the tinsel of celebrity or high office. He stands as an inspiration to all who would take the hemlock to defend the Constitution period, with no commas, question marks, or semicolons. The Committee for the Republic is honored to feature Judge Luttig at its September 17, 2024, salon to examine the worst decision in the history of the United States Supreme Court that took an already ailing Constitution off life support: Trump v. United States, a judicial counterrevolution against the rule of law as king.It is altogether fitting that we do this. The crown jewel of the Constitution, the nation’s birth certificate, was separation of powers pitting knaves against knaves to protect liberty. The Supreme Court stole the crown jewel in Trump. It endowed the President with limitless power, de facto or de jure, to commit crimes like Russia’s President Vladimir Putin or China’s President Xi Jinping. An exaggeration? Chief Justice John Roberts did not dispute dissenting Justice Sonya Sotomayer’s chilling hypotheticals: “[The President] [o]rders the Navy’s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon. Immune. Immune, immune, immune.” Do not indulge the fantasy that the King in the White House does not threaten you. We’ve seen this rodeo before as related by Martin Niemöller after spending eight years in Nazi prisons and concentration camps: "First they came for the socialists, and I did not speak out—because I was not a socialist. Then they came for the trade unionists, and I did not speak out—because I was not a trade unionist. Then they came for the Jews, and I did not speak out—because I was not a Jew. Then they came for me—and there was no one left to speak for me."
