Public Law Lecture - Police Powers 1

A video for students studying public law on LLB and GDL courses. This lecture in particular looks at police powers including stop and search as well as search of premises. Stop and search is authorised under section 1 of the Police and Criminal and Evidence Act 1984 (PACE). The Act was a response to the Brixton riots of 1981 as well as the Scarman report. In order for a stop and search to take place there must be reasonable suspicion that the person is carrying: stolen items; offensive weapons; fireworks; items intended for use in the commission of burglary, theft, taking a vehicle without authority, fraud and criminal damage. Reasonable suspicion must be based on current police intelligence. The stop and search takes place in public so only outer clothing can be removed. The officer must give their name and station, the object of the search and the grounds for the search. Premises may be searched with a warrant granted by a magistrate under the grounds listed in section 8. Without a warrant a search of premises may still take place under sections 17, 18 and/or 32. There is also the possibility of the police bugging premises so long as it is done in accordance with the Police Act 1997. This ensures compliance with the right to private life under Article 8 of the European Convention on Human Rights. Once on the premises the police may seize any evidence that may be relevant to any case as seen in Jeffrey v Black [1978].
