दोस्तो स्वाfगत है हमारे चेनल हिन्दीा कानूनी जानकारी (hindi kanuni jankari) में about this video धारा 1 भारतीय न्याय संहिता | Section 1 BNS in Hindi | Short title commencement and application Section 1 in THE BHARATIYA NYAYA SANHITA, 2023 इस आर्टिकल में मै आपको “संहिता नाम, प्रांरभ और लागू होना | भारतीय न्यानय संहिता की धारा 1 क्या है | section 1 BNS in Hindi | Section 1 in The bhartiy nyay sanhita| BNS Section 1 | Short title commencement and application” के विषय में बताने जा रहा हूँ आशा करता हूँ मेरा यह प्रयास आपको जरुर पसंद आएगा । तो चलिए जानते है की – भारतीय न्यामय संहिता की धारा 1 | Section 1 in The Bhartiya Nyay Sanhita Dhara 1 [ BNS Sec. 1 in Hindi ] – 1. संहिता नाम, प्रांरभ और लागू होना (1) इस अधिनियम को भारतीय न्याय संहिता, 2023 कहा जा सकता है। (2) यह उस तारीख से लागू होगा जो केंद्र सरकार अधिसूचना द्वारा जारी करेगी सरकारी राजपत्र में नियुक्ति, अलग-अलग प्रावधानों के लिए अलग-अलग तिथियां निर्धारित की जा सकती हैं इस संहिता का. छोटा शीर्षक, प्रारंभ और (3) प्रत्येक व्यक्ति इस संहिता के तहत दंड का पात्र होगा, अन्यथा नहीं उसके प्रावधानों के विपरीत प्रत्येक कार्य या चूक, जिसके लिए वह दोषी होगा भारत। (4) कोई भी व्यक्ति जो भारत में उस समय लागू किसी भी कानून के तहत मुकदमा चलाने के लिए उत्तरदायी है भारत से बाहर किए गए अपराध से इसके प्रावधानों के अनुसार निपटा जाएगा भारत से बाहर किए गए किसी भी कृत्य के लिए संहिता उसी प्रकार है जैसे कि ऐसा कृत्य किया गया हो भारत के अंदर प्रतिबद्ध. (5) इस संहिता के प्रावधान निम्नलिखित द्वारा किए गए किसी भी अपराध पर भी लागू होंगे- (ए) भारत के बाहर और बाहर किसी भी स्थान पर भारत का कोई भी नागरिक; (बी) भारत में पंजीकृत किसी भी जहाज या विमान पर कोई भी व्यक्ति, चाहे वह कहीं भी हो; (सी) भारत के बाहर और बाहर किसी भी स्थान पर कोई भी व्यक्ति लक्ष्यीकरण अपराध कर रहा है भारत में स्थित एक कंप्यूटर संसाधन। स्पष्टीकरण.-इस धारा में, "अपराध" शब्द में बाहर किया गया प्रत्येक कार्य शामिल है जो भारत में किया जाए तो इस संहिता के अंतर्गत दंडनीय होगा। चित्रण। ए, जो भारत का नागरिक है, भारत के बाहर और बाहर किसी भी स्थान पर हत्या करता है। उस पर भारत में किसी भी स्थान पर, जहां वह पाया जा सकता है, हत्या का मुकदमा चलाया जा सकता है और उसे दोषी ठहराया जा सकता है। (6) इस संहिता की कोई भी बात विद्रोह को दंडित करने के किसी भी अधिनियम के प्रावधानों को प्रभावित नहीं करेगी और भारत सरकार की सेवा में अधिकारियों, सैनिकों, नाविकों या वायुसैनिकों का परित्याग या किसी विशेष या स्थानीय कानून के प्रावधान।धारा 1 BNS [ BNS Sec. 1 in English ] – “Short title commencement and application”– (1) This Act may be called the Bharatiya Nyaya Sanhita, 2023. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Sanhita.. (3) Every person shall be liable to punishment under this Sanhita and not otherwise for every act or omission contrary to the provisions thereof, of which he shall be guilty within India. (4) Any person liable, by any law for the time being in force in India, to be tried for an offence committed beyond India shall be dealt with according to the provisions of this Sanhita for any act committed beyond India in the same manner as if such act had been committed within India. (5) The provisions of this Sanhita shall also apply to any offence committed by— (a) any citizen of India in any place without and beyond India; (b) any person on any ship or aircraft registered in India wherever it may be; (c) any person in any place without and beyond India committing offence targeting a computer resource located in India. Explanation.—In this section, the word “offence” includes every act committed outside India which, if committed in India, would be punishable under this Sanhita. Illustration. A, who is a citizen of India, commits a murder in any place without and beyond India. He can be tried and convicted of murder in any place in India in which he may be found. (6) Nothing in this Sanhita shall affect the provisions of any Act for punishing mutiny and desertion of officers, soldiers, sailors or airmen in the service of the Government of India or the provisions of any special or local law.
