The statute is very broad and prosecutors think it is easy to convict individuals for it. The federal crime of conspiracy occurs when two or more people plan to commit a crime together and take some sort of action to accomplish it. This action is called an "overt act" and describes a material step that an individual takes to accomplish the goal. As attorney David Tarras explains, most courts require that prosecutors prove that an overt action took place in order to convict a suspect for conspiracy. Merely two individuals discussing a plan to commit a crime is not enough for most courts to convict for conspiracy. Conspiracy, when tacked onto its predicate offense, often carries the same penalties as the offense itself. If an individual is prosecuted for a general conspiracy charge as in 18 U.S.C. § 371, then the individual could be facing fines and imprisonment for up to 5 years. A defense attorney can create reasonable doubt that the defendant is guilty of a crime.
