Can I Work While Waiting for a Decision in My Social Security Disability Case?

In order to win disability benefits from Social Security, you have to prove that your medical issues prevent you from working. So how is it even possible that you could consider working, even part time. The answer, as I discuss in this video, has to do with how Social Security defines work, or more accurately, how it defines "substantial gainful activity." (SGA) Part time work below a certain threshold is NOT considered "substantial" by SSA, so earning below this limit does not disqualify you from pursuing benefits. Does NOT disqualify you! In 2024, your work is considered "substantial" if you are earning $1,550 per month (gross earnings) or more. So on-going earnings below this threshold are not an issue unless the disability judge thinks that you are intentionally suppressing your income so that you can qualify for benefits. The SGA amount changes every year and the table of SGA limits is at https://www.ssa.gov/oact/cola/sga.html. If you exceed the SGA limits a few times while your case is pending, you are NOT automatically disqualified either since you can argue that your over SGA earnings are an "unsuccessful work attempt. Ideally, an applicant for Social Security disability benefits will not work at all since ongoing work activity could raise concerns or suspicions in the judge's mind. But the reality of long wait times (two to three years in many disability cases) means that disabled claimants MUST try to return to work.
