In re Marriage of Graham | 574 P.2d 75 (1978) It happens all the time. A young couple marries. One of them works to support the family while the other pursues a degree or professional education. Then, right after graduation, they divorce. Is the supporting spouse entitled to any of the benefits of that education? The Supreme Court of Colorado considered that question in the 1978 case, In re Marriage of Graham. Dennis and Anne Graham married in 1968. During their six-year marriage, Anne worked full-time as a flight attendant. Dennis worked part-time, but focused on earning a bachelor’s degree in engineering physics and a master’s degree in business administration, commonly referred to as an MBA. Following graduation, Dennis found a job in a large corporation, earning $14,000 a year, or approximately 85,000 in 2019 dollars. They’d accumulated no marital property and didn’t have children. Dennis and Anne jointly petitioned for divorce, and Anne didn’t seek maintenance. The trial court determined that Anne had contributed 70 percent of the support for the family and for Dennis’s education. The trial court ruled that Dennis’s education was jointly owned property. After an economist testified regarding an MBA’s value, the court ruled that Dennis’s MBA was worth approximately $82,000, and Anne was entitled to approximately $33,000 of that. Dennis was to pay her at the rate of one hundred dollars a month. The court of appeals reversed, holding that an education wasn’t property subject to division in a divorce.
