The development came after a five-judge Constitution Bench, led by Chief Justice of India (CJI) DY Chandrachud, delivered the judgment on Thursday with a 4-1 majority while Justice JB Pardiwala dissented, calling for Section 6A to be struck down with prospective effect. The court ruled that the Assam Accord was a political solution to manage illegal migration in Assam, and Section 6A was the legal response. The majority found that Parliament had the authority to pass this law, balancing humanitarian concerns with the need to protect the local population. The judges also dismissed claims that Assam was unfairly singled out compared to other states bordering Bangladesh. They reasoned that the higher percentage of migrants in Assam, compared to states like West Bengal, made the law necessary. The court upheld March 25, 1971, as the cut-off date for recognizing migrants, which coincided with the end of the Bangladesh Liberation War. Migrants who entered before January 1, 1966, will be granted citizenship. Those who entered between January 1, 1966, and March 25, 1971, can apply for citizenship if they meet the criteria.
