Utilizing SB 1141, California's 'Coercive Control' Bill: A Training for Practitioners

This training will cover the provisions in the 2020 Senate Bill 1141 (SB 1141), which goes into effect on January 1, 2021, and which incorporates "coercive control" into the definition of abuse under the Domestic Violence Prevention Act (DVPA), the statutory scheme governing domestic violence restraining orders. The definition of abuse under the DVPA governs what abuse qualifies for a domestic violence restraining order and governs what abuse qualifies for purposes of uncharged past acts of abuse for purposes of character evidence in criminal legal proceedings. The training will cover pre-SB 1141 case law, the language of SB 1141 itself, and potential implications of SB 1141 on family and criminal law cases going forward. Presenters: Cory Hernandez, Family Violence Appellate Project Pallavi Dhawan, LA City Attorney's Office Stephanie Baez, San Diego Volunteer Lawyer Program MCLE: 1.5 hours general This training is produced by the Legal Aid Association of California (LAAC). LAAC produces trainings designed for civil legal aid and pro bono attorneys throughout the state, bringing the experts directly to the advocates helping low-income Californians. Technology permitting, all trainings are recorded and archived for later on-demand viewing by advocates.
