Hall Booth Smith's Terrell Benton III tells jurors that, although an anesthesiologist's participation in a music video during surgery was unprofessional, it did not constitute a breach of the medical standard of care under Georgia tort law. The anesthesiologist, Dr. Gerald Pinkney, danced and appeared to sing to a video titled "Cut It," while a Georgia woman was under anesthesia during surgery. The video was made by the procedure's surgeon, Dr. Windell Boutte, known as the "Dancing Doctor" for dozens of similar videos in which she danced, sang, and gestured while patients were under anesthesia. The patient in the procedure claimed the publication of the video, which went viral with more than a million views, left her emotionally traumatized. Jurors in the trial against Pinkney declined to award any monetary damages, cleared the anesthesiologist of fault in the case, and assigned 100 percent of liability to Boutte, who was not a defendant at this trial.
