"In 1951, a labor dispute arose between the United States steel companies and their employees. The following year, President Harry Truman issued an executive order directing the Secretary of Commerce to take possession of the nation's steel mills. The steel mills challenged the seizure and the case was resolved by the SCOTUS less than eight weeks later. In spite of the dissenters being the president's poker buddies, therefore giving him flexibility to deal with this emergency, a 6-to-3 decision surfaced. The court held that the president did not have the authority to issue such an order. One Supreme Court justice's concurrence has continued to shape the way we think about executive power to this day.
