In the last few years, federal deference doctrines have received a lot of attention, especially with the Supreme Court’s high profile Kisor decision last term. But less attention has been paid to the topic of deference in the states. In the past few years at least a half dozen state courts have rejected deference, expressing concern about the impact deference has on judicial supremacy and the separation of powers. There has also been a concerted effort to reign in deference at the ballot box and in the state house. To analyze these trends and discuss the impact they are having on litigation and advocacy efforts across the country, please join us for a Webinar where experts will discuss these trends and whether they are an unusual blip or the start of a broader trend against deference.
