The VA has its own rules governing how attorneys may charge for their services. First, note the differences between an accredited veterans disability attorney and a veterans services (VSO) representative. A VSO representative can help veterans file their initial claims, fill out paperwork, get to and from medical examinations, and appeal a claim to the Board of Veterans Appeals. A VSO representative may not offer legal advice or represent a veteran in court. He or she can represent the veteran before the Board of Veterans Appeals, but not in later appeals in federal court. An accredited attorney can offer legal advice and represent the veteran at any stage of the appeals process, which does not include the initial claim. The attorney must wait to get involved until after the initial claim has been decided. Attorneys may charge a contingency fee for their services, meaning the veteran pays nothing upfront, and the attorney is only paid a percentage of any past-due benefits recovered. An attorney is never paid out of future benefits to be paid. Federal law states that a contingency fee of twenty percent of any past-due benefits is presumed to be a reasonable fee. A fee of thirty-three and a half percent is presumed to be an unreasonable fee. However, in every case, the VA is allowed to ask for more information to determine whether the particular circumstances of the case justify a lower or higher fee. Factors the VA considers to determine whether a fee percentage is reasonable include: the services performed, the complexity of the case, the level of skill and competence required, the amount of time spent on the case, the results achieved, the level of review to which the claim was taken, rates charged by other representatives, whether and to what extent the payment of fees is contingent upon the results achieved, and the reasons an agent or attorney may have withdrawn from the case.
