His conviction was later quashed by the High Court, with one presiding justice stating that they had the "gravest misgiving about the circumstances of [the] case". In a 2021 lawsuit against the state government and the investigating police officer, the Queensland Court of Appeal found Mr Irving was maliciously prosecuted by the investigating police officer while he was being held on charges of accessory to armed robbery.
