Right of Freedom | Part 3 of Constitution | Article 19 to 21 Articles 19 to 22 of the Indian Constitution guarantee the fundamental right to freedom to all citizens of India. These articles are collectively known as the Right to Freedom. Article 19 guarantees six freedoms: Freedom of speech and expression Freedom to assemble peaceably and without arms Freedom to form associations or unions Freedom to move freely throughout the territory of India Freedom to reside and settle in any part of India Freedom to practice any profession, or to carry on any occupation, trade or business Freedom to acquire, hold and dispose of property These freedoms are not absolute, and can be restricted by the state in certain circumstances, such as in the interest of public order, morality, or security. Article 20 protects citizens from being arrested without a warrant, and from being tried for the same offense twice. Article 21 guarantees the right to life and personal liberty. This right cannot be taken away by the state except as per the procedure established by law. The Supreme Court of India has interpreted the Right to Freedom to be a very broad and fundamental right. It has held that the state can only restrict these freedoms in the rarest of cases, and only if the restriction is necessary and proportionate to the purpose it seeks to achieve. The Right to Freedom is one of the most important fundamental rights guaranteed by the Indian Constitution. It is essential for the protection of individual liberty and for the promotion of democracy and free speech.
