In 1993, the Daubert v. Merrell Dow Pharmaceuticals ruling created the Daubert standards which became the benchmark of qualifying and disqualifying expert witnesses. These standards include: Theory or technique in question can be and has been tested. Theory or technique has been subjected to peer review and publication. Theory or technique have a known potential error rate. Existence and/or maintenance of standards of practice. Theory or technique has gained widespread acceptance within a relevant scientific community. When applying the Daubert standards to the medical damages field, specifically Life Care Planning, the theory or technique refers to the standards of practices, peer-reviewed definitions, and processes outlined in the associations and certification boards as well as the published core curriculum/textbooks and journals. Life Care Planning does not have a known potential error rate as each individual is unique in their medical condition and future medical care.
