While patrolling my assigned zone in my marked patrol unit #21, I observed a red-colored Cadillac CTS idling with dark-tinted windows in violation of N.J.S.A 39:3-74 (Obstruction of Windshield) at an intersection. The motorist started operating the vehicle carelessly above the posted speed limit northbound on the road, in violation of N.J.S.A 39:4-97 (Careless Driving). I safely positioned my patrol unit behind said vehicle and activated my emergency overhead lights, advising headquarters of my location and providing them with the vehicle's registration number, which was affixed to the rear of the vehicle. Upon making a safe passenger-side approach to the vehicle, I observed the motorist throwing what appeared to be a glass bottle under the front passenger-side seat. It should be noted while making my approach, I observed a small glass vial behind the driver seat and a tall glass beer bottle on the front passenger seat floor. I requested the motorist license, registration, and insurance. The motorist stated she was traveling home at the time, I immediately smelled a strong order of an alcoholic beverage emanating from within the vehicle. It should be noted that the motorist's eyes were red, watery, and droopy eyelids. I asked the motorist if she was drinking that evening, but she did not wish to answer any questions. I further advised the motorist that a backup officer would arrive on the scene to test if she could operate a motor vehicle safely. Backup officers arrived on the scene as my backup officers. As backup officers arrived, the motorist stepped outside the car, requesting further information regarding the interaction. At this time I requested HQTS check the motorist for any outstanding wants or warrants which was negative at this time. A vehicle search revealed an empty bottle of Corona Beer located on the front passenger floor, one empty vial of Amsterdam Vodka located behind her driver seat, two half-empty vial of Amsterdam located in the center console, and one empty pack of "Gorilla Glue" packaging of suspected marijuana located in the driver-side door. Photos of the above-mentioned items were taken utilizing Axon Capture for evidence. Once at HQTS, an officer and I escorted the suspect to the classroom and secured her to the SPD prisoner bench. The suspect became physically aggressive; at this time, a sergeant placed ankle shackles as she repeatedly attempted to kick in the officer's direction on scene. I read the suspect the NJ Attorney General's Standard Statement for Motor Vehicle Operations verbatim, to which the defendant responded "Yes" to providing breath samples captured on my body-worn camera. While the sergeant was talking with the suspect, she requested I read the NJ Attorney General's Standard Statement for Motor Vehicle Operations again because she only speaks Spanish and does not understand English. At this time, an officer utilized the NJ Attorney General's website for the Spanish translation of the NJ Attorney General's Standard Statement for Motor Vehicle Operations, to which she responded she did not wish to comply. At this time, the suspect was sliding on the floor from the SPD Prisoner bench as the sergeant picked her up; she attempted to bite him on his left arm. To prevent injury to himself, the sergeant took the suspect down to the floor and pinned her down with his right forearm. The sergeant asked the suspect, "are you done?" to which she replied "yes". The suspect was helped off the floor and secured to the SPD prisoner bench utilizing two sets of handcuffs. As the suspect was taken down, her head hit the floor and she requested an ambulance for a complaint of pain. An officer generated a complaint for resisting arrest (2C:29-2), which the sergeant approved. At approximately 0208 hours, EMS arrived at HQTS to escort the suspect to the hospital. An officer rode in the rear of the ambulance, and another officer followed in a marked patrol unit. The first officer took the suspect's photo for Lawsoft utilizing Axon Capture due to the suspect being in the hospital. At 0339 hours, the suspect was released from police custody and signed her own recognizance.
