Family Court Practice 2023

BOOK REVIEW THE FAMILY COURT PRACTICE 2023 General editor: District Judge Charles Prest KC ISBN 978 1 78473 501 2 LEXISNEXIS/ FAMILY LAW www.lexisnexis.co.uk THE RED BOOK REMAINS THE MOST DETAILED WORK ON PRACTICE IN FAMILY LAW AVAILABLE TO THE LEGAL PROFESSION An appreciation by Elizabeth Robson Taylor MA of Richmond Green Chambers and Phillip Taylor MBE, Head of Chambers, Reviews Editor, “The Barrister”, and Mediator “The Family Court Practice”, or “The Red Book” is an annual practitioner publication from LexisNexis Butterworths arriving normally around May each year. Red in colour (hence the title), it covers the entire range of family business and contains all the essential materials you need to practice in the Family Court. Without doubt it is fundamental for any practitioner in the family courts. The first edition appeared in 1993 with founding editors, Joyanne Bracewell, and Anthony Cleary, and is now edited by District Judge Charles Prest KC. Since then, our working patterns have changed and many no longer want or have need for printed versions of leading works, so the editor and his team continue to review the content and approaches needed for the 2020s. We are entering changing times with this 2023 edition as family procedure modernises to meet the demands of computer integration. The editor and his team of contributions appreciate any comments which users of the Red Book wish to offer to improve the service we receive from LexisNexis for this as the book family judges and practitioners use. The 2023 edition has, as usual, been fully updated to include the latest case law, full coverage of new and amended legislation, Practice Directions, and Guidance Notes. We also have fully and expertly annotated statutes and rules together with scores of unique step-by-step procedural guides, which direct us effortlessly to the relevant rules and annotation. The new material for the 2023 edition includes additional legislation including Civil Evidence Act 1968 (convictions, privilege against self-incrimination) and Civil Evidence Act 1995 (hearsay). ‘Family proceedings: Prohibition of cross-examination in person’ has now integrated the Matrimonial and Family Proceedings Act 1984, Part 4B. The editorial team offer us excellent updated commentary throughout as we have come to expect. There are also useful commentaries on financial remedies, child support and child abduction. We have updated Procedural Guides, too, including a new guide to an application for a legal services payment order. The editor has removed the ‘old’ divorce law and procedure. We have an update on the Family Procedure Rules, plus latest Practice Guidance. Also included is an introduction to Welsh Materials which have been brought within main work. The online archive which was created with previous editions of the Red Book from and including 2020 continues as the editor and his colleagues review the way in which this practice volume moves forward as the digital age begins to change the way the legal profession conducts its business and its processes. LexisNexis are always keen to consider from users of the book how it can improve the service on offer in paper or digital form as changes to the way we practice continue to change in family law. The date of publication of this new annual hardback edition for 2023 is cited as 25th May 2023.
